Shipping Policy

TITLE AND OWNERSHIP

Title to, and ownership of, all wine passes from Somm Cartel LLC to the purchaser in the State of Florida and the purchaser takes all responsibility for the shipping of it from Florida to his/her home state. By arranging for transportation of the wine via common carrier, Somm Cartel LLC is providing a service to, and acting on behalf of the purchaser. You will be billed for this service. By utilizing this service from Somm Cartel LLC, the purchaser is representing that he/she is acting in a fashion compliant with his/her local and state laws regarding the purchase, transportation and delivery of wine. The purchaser represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered and once again authorizes that he/she is 21 years of age.

DELIVERY ATTEMPT

It is the Customer's responsibility to be present at the time of delivery for an adult signature. If no one is available to receive the package, a subsequent attempt to deliver will be made. Whenever possible, we encourage you to use a commercial business address to assure the fastest delivery time. If subsequent attempts are unsuccessful, your order will be returned to Somm Cartell LLC. The Customer will be required to incur the cost of shipping and handling, regardless of the Customer deciding to cancel the order.

TRANSIT TIMES

Please keep in mind that there is an order processing period during non-holidays times of 1 - 7 business days. Once the order is shipped, you will receive a tracking number to your email address.

Limited Liability

 

Somm Cartel LLC is not responsible for personal data or items left in returned merchandise. Somm Cartel LLC is not responsible for any consequential or incidental damage resulting from the sale or use of any merchandise bought from us. We are responsible for the monetary value of the merchandise only. Also, claims for missing items or items damaged in transit must be received within two business days of receipt of merchandise.

PRE-ARRIVAL SALES

Somm Cartel LLC sells some wines on a pre-arrival basis, which means the wine has not yet arrived to us and is not available for immediate shipping. These wines are designated in our web catalog and the shopping cart as "pre-arrival" rather than "in stock". Payment for pre-arrival wines is due when your order is placed. Once we receive your complete order, Somm Cartel will then package and ship your order with one of our common carriers to the address provided. 

Delivery dates (ETA's) given at the time of your order are estimates only and provided as guidance, not a promise or guarantee of delivery time. We make every effort to receive wines purchased on a pre-arrival basis within these estimates.

INTERNATIONAL ORDERS

Somm Cartel LLC does not facilitate the shipment of products outside of the continental United States. If you are a client who lives outside of the continental United States please make arrangements for your order to be delivered to an appropriate address within our shipping territory. 

DAMAGED PRODUCT

In an effort to prevent fraud; please provide photographic evidence of the damaged items. The pictures need to be clear and include the sealed neck of every bottle claimed as damaged. No exceptions!

If multiple bottles are damaged, we need a picture of individual bottles and another picture of all the damaged bottles together in one picture.

If the charge is disputed as damaged / defective item, we need the same proof as mentioned above.

CANCELLATIONS

Any purchase cancelled or refund requested of any special item(s) will incur a 25% restocking fee as these special items are non-returnable to our suppliers. Please be advised; we can only refund the original purchase price as shipping and handling fees are nonrefundable.  

 

Refunds (100%)

A full refund is gladly given if you request to cancel within 1 business day of the order date, or prior to shipment, whichever comes first. This applies to all orders of in stock wines and pre-arrival wines.

 

Refunds Subject to Cancellation Fees

After 1 business day, you can still request to cancel for up to 7 business days from the date of your order, or prior to shipment, whichever comes first.

A 15% cancellation fee will be deducted from your refund.

This applies to all orders of in stock wines and pre-arrival wines,

 

Refunds and Credits:

Once returned items are received and inspected, we will credit your account. Please allow 5-7 days for a credit to appear on your account. Refunds will be issued in the same manor of original payment and will only reflect the original purchase price of the product as shipping and handling fees are nonrefundable, unless an incorrect item was sent.

If your order has shipped, please refer to our “Return Policy” instead.

 

Exceptions to Cancellation Policy

  • Delayed Pre-Arrival Purchases: Somm Cartel LLC sells some wines on a pre-arrival basis, which means the wine has not yet arrived to us. Payment for pre-arrival wines is due when your order is placed. We will notify you when your wines arrive and are ready for shipment. Once received by our common carrier, we will email you with notification and a tracking number.

    Delivery dates given at the time of your order are estimates only and provided as guidance, not a promise or guarantee of delivery time. We make every effort to receive wines purchased on a pre-arrival basis within these estimates.

    Requests to cancel an order that are not significantly delayed beyond our original estimate are subject to a 15% cancellation fee.

    Orders significantly delayed will not be subject to the cancellation fee. Significant delays are delays greater than 9 months.

    Somm Cartel will not be liable for incremental or consequential damages, nor be required to source a replacement on orders canceled for reasons of delayed arrival.

RETURNS

Somm Cartel LLC guarantees quality products and service and your satisfaction is our first priority! However, if you wish to return a purchase after you receive it please see below for our return policy.

We will gladly accept your request for return if you notify us within 3 business days after final delivery to the recipient.

Returned bottles must be in unopened, resalable condition and shipped back to us in packaging specifically designed for shipping wine.

When your return is received and inspected, we will issue a refund, minus a 15% restocking fee and any additional shipping cost incurred by Somm Cartel LLC for return shipping.

​

The 15% restocking fee is assessed on the original sales order value of the returned items.

Original shipping or delivery fees paid by the buyer are not refundable.

​

The above policies additionally apply to shipments refused by the recipient, for incorrect shipping address provided by the buyer, and for shipments the carrier returns to us as “undeliverable”.

Exceptions to Return Policy

We do not accept returns for any of the below reasons:

  • All wine sold by Somm Cartel LLC is maintained under optimum conditions. Wines that have been adversely affected due to improper storage or treatment while in the buyer's care cannot be returned.

  • Opened bottles that are not to your personal taste.

  • Returns based on price changes within the marketplace.

  • Special orders for wines sourced specifically at the buyer’s request and not part of our regular inventory.

  • Any bottles purchased and shipped via blind ship membership.
